“Physician, APRN, and provider’s responsibilities under the public health law”
A health care professional who knows about a patient’s advance directive is bound to follow the patient’s living will and/or directives of the patient’s agent. A physician or APRN who is unable to comply with the advance directive due to personal beliefs or conscience must make a transfer to another physician or APRN chosen by the patient, the patient’s agent, or the patient’s family.
A copy of the patient’s advance directive must be included in the patient’s medical record.
Any person who possesses a patient’s advance directive or a revocation of the advance directive must provide the document to the patient’s health care provider if the person is aware that the document is necessary.
