“Disclosure of certain information under the public health law”
A community mental health center or a state facility providing services to mentally ill clients may disclose medical information to a patient’s family member or other person if the family member or person lives with a client or provides direct care to the client. The mental health center or facility must provide a written notice to the client which includes the name of the person requesting the information, the specific information requested, and the reason for their request. Prior to the disclosure, the mental health center or facility must request in writing the consent of a client. If consent cannot be obtained, the client must be informed of the reason for the intended disclosure, the specific information to be released, and the person to whom the disclosures to be made.
A community mental health center or state facility may request medical information from any health care provider which previously provided services to any person involuntarily admitted to the facility. Prior to requesting the patient’s medical information, the facility must request in writing the patient’s consent for the request for information. If consent cannot be obtain, the facility must inform the patient in writing of the health care providers who had been contacted to deliver information.
