An insurer may require an applicant for coverage to submit to an HIV test in conjunction with tests for other health conditions. The insurer must obtain the applicant’s written consent for the test and inform the applicant of the purpose of the test. The insurer may disclose the results of a positive HIV-test to the following:
- The applicant;
- The applicant’s or insured’s physician or other health care provider if the applicant or insured provides prior written consent for disclosure;
- Another person that the applicant or insured specifically designates in writing; and
- A medical information exchange for insurers operated under procedures intended to ensure confidentiality.
