Every Patient Safety Organization (PSO) must obtain certification by the department of health before contracting with a “reporting entity” (e.g. hospitals, nursing facilities, ambulatory surgical centers). PSOs will provide reporting entities with guidance on reported patient safety issues and will release recommendations regarding “best medical practices” and “potential system changes designed to improve patient safety and the overall quality of care.”

Information obtained by PSOs from reporting entities is confidential, privileged, and immune from discovery. PSOs must establish safeguards and security measures to ensure that such information remains confidential and must comply with the HIPAA regulations regarding protected health information.
