Requirements for Genetic Testing and Written Informed Consent – N.Y. Ins. Law § 2615

No authorized insurer or person acting on its behalf may request or require that an applicant undergo a genetic test without receiving the applicant’s prior written informed consent to such test, which must consist of the following:

  • A general description of the test;
  • A statement of the purpose of the test;
  • A general description of each specific disease or condition tested for; and
  • The name of the person or categories of persons and organizations to which the test results may be disclosed.

 

All records, findings, and results of any genetic test are confidential and may only be disclosed with written authorization from the individual.
