Requirements for Confidentiality of Proceedings and Disclosure of Communications, Records and Determinations of a Peer Review Committee
This regulation limits the disclosure of communications, records and determinations of a peer review committee to:
- the peer review committees of other health care facilities, such as hospitals, nonprofit health care organizations,
- the disciplinary authority of the relevant professional organization
- the appropriate state board of registration and licensure
These documents are otherwise required to be kept confidential unless the provider in question files a written waiver of confidentiality with the peer review committee. In the event that there’s a conflict between this rule and Ind. Code §27-13-31, $27-13-31 governs.
