When a physician gains knowledge that an individual is infected with a threatening contagious disease, the physician must inform local public health officials. If the infected individual refuses voluntary treatment or to be detained or observed, a local public health official can petition the court to order that the individual be detained. The petition must specifically state the individual is actively infectious with the contagious disease, many transmit the disease to others, and has refused voluntary treatment. The court may grant an ex parte order calling for immediate detention or a temporary protective order.
