Substance abuse treatment information is confidential and privileged to the patient, and may only be disclosed in accordance with federal and state law. Substance abuse treatment information must be forwarded to the commissioner as required by regulation. Substance abuse treatment information may only be accessible in accordance with N.Y. Mental Hyg. Law § 33.13, which governs the confidentiality of mental health records. Information may also be disclosed pursuant to court order, but the statute does not give further specifications.
