The Commissioner of Public Health may adopt regulations, as necessary, governing “the use of electronic signatures for medical records maintained in hospitals.” The Department of Public health must approve hospitals’ protocols for using electronic signatures in the absence of such regulations. Hospital protocols must include privacy and security protections for confidential patient information and medical records.
