Hospital directors must, within five days of admitting a patient pursuant to the mental hygiene laws, provide the mental hygiene legal service with the patient’s records. This requirement does not apply if the patient is an informal patient or is admitted under § 9.39 or § 9.40.
The commissioner may establish regulations requiring hospital directors to send the department patient record information whenever they send such information to the mental hygiene legal service.
