Protection Mechanisms for Insurance Payment Information

This section of the law under Title 11 of the New York Social Services Act—Medical Assistance for Needy Persons—sets forth in great detail the rules that the department of social security has to use to determine eligibility and amount of medical assistance available through medical assistance program in New York.  The law further sets forth the process for paying medical service providers under this program.  The law also goes into detail to explain how the New York medical assistance program works in relation with federal social security programs (like Medicare and Medicaid), and after the institution of the health insurance exchanges under the Affordable Care Act.  In a health information context, this section of the law requires that insurance carriers have mechanisms in place to ensure that the confidentiality of all “individually identifiable information or records” of those seeking medical assistance under this program is maintained.
