Prohibition Against use of Genetic Information and Requests for Genetic Testing
Prohibits carriers of Medicare supplement insurance from denying or excluding coverage based on genetic information or changing the price of the policy based on genetic information. Clarifies that carriers may—unless otherwise limited by law— deny or limit the policy’s effectiveness or increase the premium price based on the manifestation of a disease. Prohibits carriers from requiring a person or their family member to undergo genetic testing, but permits them to request such testing if they comply with specified conditions (e.g., they do not use the information for underwriting purposes, they notify the individual that such testing is voluntary, etc.).
