Procedure
Requires persons admitted to a psychiatric care facility to receive information regarding psychiatric advance directives and assistance in completing an advance directive if they so choose. Requires the Mental Health Division to create a standard advance directive form and to make this form available to facilities. Specifies the information that an advance directive must include (e.g., person’s name, social security, signature, etc.). Permits a person to revoke their advance directive at any time unless they are mentally incapacitated. Grants the agent designated by a person in their advanced directive the ability to receive information regarding the person’s care and to consent to the release of the person’s medical records.
