Health care facilities that receive reports from persons “other than a physician or a certified registered nurse practitioner or physician assistant” regarding the abuse or neglect of a patient must have the patient examined by a licensed health care professional. The health care professional must report the results of the exam to the department of health or, if the facility at issue is a community residence for persons with mental or developmental disabilities, the department of behavioral services, developmental disabilities and hospitals. Initial reports must be made within 48 hours of the exam and must be followed by a written report within 5 days of the exam.
