Physician, hospital and department abortion reports – Ohio Rev. Code Ann. § 3701.79

An attending physician must complete a confidential abortion report for each abortion he performs.  The report may not contain the woman’s name, and must include the following:

  • Date of the abortion;
  • The following information about the woman on whom the abortion was performed:
    • Zip code of residence;
    • Age;
    • Race;
    • Marital status;
    • Number of previous pregnancies;
    • Years of education;
    • Number of living children;
    • Number of previously induced abortions;
    • Date of last induced abortion;
    • Date of last live birth;
    • Method of contraception at the time of conception;
    • Date of the last day of menstrual period;
    • Medical condition at the time of abortion;
    • Rh-type; and
    • The number of weeks of gestation at the time of abortion;
  • Type of procedure used;
  • Type of procedure performed after the abortion;
  • Complications by type; and
  • Type of additional counseling given.

The attending physician must submit the report to the department of health within fifteen days after the woman is discharged.  A copy of the report will be made a part of the patient’s medical record at the facility. 

Each hospital must monthly and annually file reports listing the number of women who have undergone a post-twelve-weeks gestation abortion and received post-abortion care.  Each case in which a physician treats a post-abortion complication must be reported to the department; such reports will be confidential. 

The department will annually issue a report of the abortion data it received in the previous calendar year, which will include the following information:

  • The total number of induced abortions;
  • The number of abortions performed on Ohio and out-of-state residents;
  • The number of abortions performed, sorted by each of the following:
    • Age, by range;
    • Race and Hispanic ethnicity;
    • Education level, by category;
    • Marital status;
    • Number of living children, by range;
    • The number of weeks of gestation, by range;
    • The county in which the abortion was performed;
    • The type of procedure;
    • The number of abortions previously performed on the woman;
    • The type of facility in which the abortion was performed;
    • The county of the woman’s residence, if the woman is an Ohio resident;
  • The number and type of reported abortion complications.

The reports compiled by the department will be available upon request; the department will additionally furnish the number of abortions organized by zip code of residence upon request.
