Rhode Island establishes a health information exchange (HIE) “to allow for electronic mobilization of confidential health care information” by health care providers, patients, the department of health, and other interested parties. Participation in the HIE is optional.
The HIE and Rhode Island Health Information Organization (RHIO) must execute and comply with HIPAA business associate agreements. These agreements must address privacy and confidentiality safeguards, prohibitions on the use and disclosure of confidential health care information, and the process for amending health care records.
Providers that participate in the HIE must still maintain medical records in accordance with applicable laws while all HIE participants must still comply with confidentiality laws regarding patient information that is not held on the HIE.
