Other exceptions to notice and opt-out requirements for disclosure of nonpublic personal financial information
The notice requirement in Wis. Admin. Code §Ins. 25.10 and opt-out requirements in Wis. Admin. Code §Ins. 25.17 and Wis. Admin. Code §Ins. 25.50 do not apply when an insurer discloses nonpublic personal financial information in any of the following circumstances:
- With the consent of or by direction of the consumer;
- To protect the confidentiality or security of an insurer's records regarding a consumer to protect against fraud, risk control, consumer disputes, to those with a legal interest relating to the consumer, or to those with a fiduciary relationship with the consumer;
- To provide information to insurance rate advisory organizations, agencies rating an insurer and other person that are determining an insurer's compliance with industry standards;
- To the extent allowed for by state and federal law, and to comply with other legal requirements and investigations;
- To a consumer reporting agency in compliance with the federal Fair Credit Reporting Act;
- In connection with a proposed or actual sale or merger of all or part of a business that includes the nonpublic personal financial information;
- For purposes related to the replacement of a group health plan;
