Health care providers that obtain individuals’ biological specimen or clinical individually identifiable health information are required to notify individuals that their biological specimen or clinical individually identifiable health information may be disclosed or retained by the provider for anonymous research or coded research. Providers must provide notice to individuals describing how the specimen or information may be used and must allow individuals to request that it not be disclosed or retained for anonymous research or coded research.
