N.Y. Comp. Codes R. & Regs. tit. 18 § 357.2 - Prohibition Against Disclosure of Information in Case Records

This regulation prohibits officers and employees of the social services districts from revealing information obtained in the course of their duty unless directly necessary for purposes of administering public assistance.  The regulation draws an exception to this when an appropriating body or social services official approves disclosure of name, address and amount received by a recipient of assistance to an agency or person entitled to the information under N.Y. Soc. Serv. Law § 136.
 
The regulation further specifically addresses release of HIV-related information, and states that N.Y. Pub. Health Law § 2782 governs any release of this information.  The regulation limits the disclosure of HIV-related information to authorized employees of the department of social services districts when reasonable necessary for them to perform their duty with respect to administering the public assistance program.  The regulation further requires that a person be designated with the authority to disclose information.
