This regulation requires that Outpatient Chemical Dependency Services for Youth or OCDY programs maintain the confidentiality of all records that would identify the youth and are related to referral, diagnosis, treatment or HIV-status. The regulation allows disclosure only in accordance with 42 C.F.R. Part 2 and Parts 309 and 1072 of title 14 of the NY Comprehensive Codes Rules & Regulation. The regulation further describes in detail the procedure for reporting instances of child abuse in these facilities.
