The administrator of a nursing home or his designee must immediately inform the resident, consult with the resident’s physician (or the medical director, if the attending physician is unavailable), notify the resident’s sponsor or authorized representative (unless the resident objects) and other proper authority of the following:
- An accident involving the resident resulting in injury potentially requiring physician intervention;
- A significant change in the resident’s physical, mental, or psycho-social status in either life-threatening conditions or clinical complications; and
- A need to alter treatment significantly.
The notification must include a description of the circumstances and cause, if known, of the illness, injury or death. A change in health status and any intervention taken must be documented in the medical record.
The administrator or his designee must also report the following:
- The death of a resident within twenty-four hours to the appropriate third-party payer;
- Any incidence of illness, injury or death due to fire or smoke inhalation of a resident within twenty-four hours to the office of the state fire marshal and to the director; and
- Any reportable diseases.
