Forty-eight hour notice to parent or guardian for minor or incompetent female -- Delivery of notice-- Exceptions
Requires abortion providers to notify the parents or guardians of an unemancipated minor or the guardian of person found incompetent of their intent to receive an abortion at least 48 hours before performing the abortion. Prohibits providers from performing an abortion without providing such notice. Specifies three circumstances in which such notice is not required: a medical emergency necessities the abortion, a person entitled to notice provides a notarized certification that they have received notice, or the minor petitions a court to find them capable of consenting to the abortion. Requires a provider, when performing an abortion due to a medical emergency, to document the emergency in the patient’s medical record.
