An insurer may not discriminate against a consumer because the consumer has opted out of disclosure of his or her nonpublic personal financial information.  Additionally, an insurer may not discriminate against a consumer for failing to authorize disclosure of his or her nonpublic personal health information.  However, the failure to provide insurance services or products based on underwriting is not unfair discrimination even if the failure is due to the consumer’s refusal to authorize the disclosure of his or her nonpublic personal information.
