Confidentiality of Client Records
Substance abuse treatment records are confidential and privileged to the patient, and may only be disclosed according to the statute.
Disclosure With Consent
A client may consent in writing to disclosure of information about their substance abuse treatment.
Disclosure Without Consent
Substance abuse treatment information may be disclosed without the client’s consent for purposes of rehabilitation, research, statistical, or medical purpose. The statute does not provide further detail on disclosure without consent.
Disclosure Pursuant to Court Order
Substance abuse treatment information is not discoverable by the state in any criminal prosecution. The statute does not prevent disclosure pursuant to court order, provided that the court ordered disclosure is in accordance with federal regulations.
