“When authorization required for disclosure of nonpublic personal health information under the Insurance Department regulations”
An insurer must obtain an authorization from an enrollee prior to disclosing the enrollee’s health information. An authorization is not required for disclosures made for insurance functions, disclosures permitted by law, disclosures made pursuant to a court order, or disclosures made to governmental agencies to comply with reporting requirements.
