“Timeframes for notification of remedies, for removal of immediate jeopardy, and for achieving substantial compliance under the division of elderly and adult services regulations”
The Department of Health and Human Services may inspect nursing facilities without prior notice. In cases where immediate jeopardy to resident exists, a nursing facility must submit in writing to the department that and deficiencies have been removed within 10 days. When deficiencies do not impose immediate jeopardy to residents, the nursing facility must submit in writing that the deficiencies have been removed within 23 days. If a nursing facility does not achieve substantial compliance, the department may refuse to pay for new admissions of residents or terminate its provider agreement.
