A health care provider must retain patient records for 5 years. In the case of a minor patient, the records must be retained until the patient turns 23 years old. Records may be retained in original form, computer disc, magnetic tape, or via microfilm or via similar technology. Records must be authenticated and stored in a computer system.
A provider must post a sign that informs patients that records will be destroyed after the period set forth above. Further, when a provider first providers services for a patient, they must provide a statement informing them that records will be destroyed after the period set forth above. If the provider does not provide the statement at the first visit, they must provide it at the next visit, or at any other time, and may be included with other written information.
