Denial, Refusal to Renew, or Disciplinary Action
The Nebraska Department of Health and Human Services Regulation and Licensure may take disciplinary action against a licensed hospital that, among other grounds, fails to comply with the Health Care Facility Licensure Act or the 175 NAC 9 regulations. Disciplinary actions must follow a specified procedure that includes giving a hospital notice of a pending disciplinary action, holding an informal conference, and allowing the hospital to contest the allegations through an administrative hearing. The department, after weighing factors that include the “gravity of the violation” and the severity of harm, may levy a fine, place the hospital on probation, issue a suspension, or revoke the hospital’s license.
