Confidentiality
All substance abuse treatment records are confidential and privileged to the patient and may only be disclosed according to the statute.
Disclosure With Consent
Patients may consent to disclosure of their substance abuse treatment information, but the statute does not elaborate on consent procedures.
Disclosure Without Consent
Substance abuse treatment information may be disclosed without consent to treatment personnel for treatment purposes.
Disclosure Pursuant to Court Order
Disclosure of substance abuse treatment information may be made pursuant to court order upon application showing good cause for disclosure; the court in determining whether to order the disclosure weighs the need for the information against the potential harm to the patient.
