Release of Patient Records to Patient
A licensed physician must provide a copy of the patient’s medical record to a patient, a patient’s representative or other person with a written release and authorization, within a reasonable amount of time upon written request. However, a health care provider may choose not to release psychological or psychiatric records to the patient if he or she requests them if the physician deems that the records would be harmful to the patient’s mental well-being. The physician may, upon request, release these records to the patient’s representative. Copies of records may not be withheld by the physician for failure of a patient to pay his or her medical bills. The physician may request payment of reasonable copying fees in advance of furnishing the copies.
