If a physician determines that their patient has a “reduced life expectancy due to an advanced illness” and recommends treatment, the physician must orally provide the patient, their surrogate, or advocate with information regarding the recommended treatment, alternative treatments, and the risks and benefits of each of these treatments. This duty to provide information does not require a physician to disclose information that falls outside the “applicable standard of practice” nor does the duty affect the physician’s informed consent duties that arise in cases of HIV and breast cancer.
