This provision does not apply to any transaction or conduct of a health maintenance organization, health insurer, medical care corporation, or health service corporation if the transaction’s goal is to reduce the cost of health care and is approved by the commissioner. However, this section does not affect the enforceability of federal antitrust laws. The labor of a human being is not considered a commodity or article of commerce for antitrust purposes. The antitrust laws do not prohibit an act of government when the act is within the subject matter area in which is it authorized to act. This provision does not apply to any acts authorized by federal law or regulation.
