Mich. Comp. Laws Ann. § 330.1717 - Electroconvulsive therapy or other procedure; consent

Michigan prohibits the administration of “electroconvulsive therapy or a procedure intended to produce convulsions or coma” without proper consent from the patient, their parent, legal guardian, or designated representative. If a guardian is the party providing consent, two psychiatrists must examine the patient, determine the procedure is proper, and document the examination and conclusion in the patient’s medical record. If a parent or guardian of a patient under 18 consents to the procedure, two psychiatrists that specialize in child and adolescent care and are independent of the treating psychiatrist must examine the patient, determine the procedure is proper, and document the examination and conclusion in the patient’s record.  Additionally, minors must be informed of their right to object to electroconvulsive therapy and their right to hearing prior to performance of the procedure.
