Within 12 hours of voluntary or involuntary hospitalization for treatment of a mental illness, a hospital director must furnish the individual with a petition asserting the need for treatment, written notice that the individual will receive a psychiatric examination within 24 hours, and written notice of their right to a hearing and legal representation. In the event that an individual lacks the ability to read or comprehend the written material, someone must attempt to explain the material to the individual in a language they can understand. A note regarding this event, including the name of the party explaining the material, must be entered into the individual’s patient record.
