“Investigation of complaint concerning home – disclosure of information”
The director of health may investigate any complaint they receive concerning a home. The director and any employee of the department of health may not release the following information unless permission has been granted by the individual or their legal representative or by court order:
- The identity of any patient or resident
- The identity of anyone who submits a complaint
- The identity of any individual who provides the director with information about a home and has asked for confidentiality
- Any information that would reasonably disclose the identity of an individual described above
Anyone that receives the above information may not release it without the permission of the individual who would be identified, unless by court order or for enforcement of a statute.
Any record that identities an individual is not a public record.
