An insurer must provide a clear and conspicuous notice outlining its privacy policies regarding nonpublic personal financial information to customers (where there is a continuing relationship) and consumers.
An insurer is not required to provide an initial notice to a consumer if any of the following conditions apply:
- The insurer does not disclose any nonpublic personal financial information to a third party and the insurer does not have a customer relationship with the individual;
- An affiliated insurer has provided notice, which clearly defines all insurers that the notice applies to.
An insurer may be required to provide a revised notice if a new product or service is used by an existing customer, unless the most recent notice provided is accurate for the new product.
