Informed consent for HIV testing is not required under the following circumstances:
- For a physician or health care facility performing testing of the medical acceptability of a donor’s body part or for artificial insemination;
- In performing a test in medical emergencies when the individual is not capable of giving or withholding informed consent and the test results are needed for medically diagnostic purposes;
- In performing a test for medical research purposes when the identity of the individual is not known;
- In performing a test where the identity of the test subject is not known, such as for public health testing or STD clinics.
