Informed Consent for HIV Treatment Not Required – N.M. Stat. Ann. §24-2B-5

Informed consent for HIV testing is not required under the following circumstances:

  1. For a physician or health care facility performing testing of the medical acceptability of a donor’s body part or for artificial insemination;
  2. In performing a test in medical emergencies when the individual is not capable of giving or withholding informed consent and the test results are needed for medically diagnostic purposes;
  3. In performing a test for medical research purposes when the identity of the individual is not known;
  4. In performing a test where the identity of the test subject is not known, such as for public health testing or STD clinics.
