An HIV test may not be performed on an individual without first obtaining informed consent of the individual taking the test. Consent does not have to be in writing if thee is documentation in the medical record that the test was explained and consent was obtained. The requirement for informed consent has a number of limited exceptions outlined in §24B-2B-5-5.3.
