Individual Rights of Persons Receiving Evaluation Care or Treatment
Establishes the rights of persons receiving treatment in mental health facilities. These rights include the ability to view their clinical record and the confidentiality of their treatment record. Clarifies that these rights are subject to other provisions of law. Requires facilities to give persons notice of these rights and to post the rights throughout the facility. Requires facilities to document the provision of rights in a person’s clinical record if the patient is under a mental health hold and the facility has petitioned a court to permit involuntary treatment.
