Ind. Code Ann. § 16-41-6-4 - HIV testing of newborns

This law allows a physician overseeing the care of a newborn infant to order a confidential HIV test on the infant within 48 hours of birth, if the mother has not had a test performed herself, the mother refuses a test for the newborn and the physician believes that the test is medically necessary.  If a parent rejects testing of the newborn for religious reasons, then the newborn is exempt from testing.  If a physician orders such an examination s/he must notify the mother and provide her with HIV information and counseling.  The test results are confidential and must only be released to the mother.  If the results are positive, the provider must inform the mother of treatment options.
