Attending physicians or health care providers are required to attach to the body of a deceased individual a notice stating “observe bodily fluid precautions” whenever a deceased is diagnosed with certain kinds of diseases (Ind. Code Ann. § 16-41-13-1). This law requires that the information regarding the deceased person’s disease should be kept confidential by the physician or health care provider, and allows for the information to be disclosed only when required by law or court order. The law states that any physician or health care provider who violated this confidentiality requirement and discloses information commits a Class A misdemeanor.
