This law states that when a patient consents in writing to the release of his/her mental health records to a health insurer covering the patient, the provider is authorized to provide the insurer with the following information:
- Patient’s name and policy number
- Date admitted to facility or date the patient began receiving mental health services
- Date of beginning of illness
- Date patient was discharged from facility or treatment was terminated
- Diagnosis
- Description of services provided to patient
- Whether patient is inpatient or outpatient
- Patient’s relationship to policyholder
- Prognosis and plan of treatment
As long as the insurance requests information reasonably related to the above categories of information, no additional written consent is required, but if the insurer requests information in addition to reasonable related information, then a written consent is required for release of the additional information.
