This law allows a person to petition in a circuit or superior court requesting the release of a patient’s mental health record, as long as the person:
- Is seeking access to the records without the patient’s consent with respect to an investigation or prosecution resulting from a report
- Has filed or is party to a legal proceeding and is seeking access to the record without the patient’s consent
