This law allows private and public mental health care providers to give access to a patient’s mental health record to an individual or organization designated by the patient or to the patient’s legal representative, as long as the patient submits a written request and gives reasonable notice. The law then sets forth a detailed list of what needs to be included in such a written request, including but not limited to: purpose of release, description of information sought, signature of patient, etc. The law limits the validity of such a written request to 180 days after the date of request, and allows the patient to revoke the release of records at any time.
