Ind. Code Ann. § 16-38-4-9 - Confidentiality of information in birth problems registry

This law requires that certified nurse midwives, certified direct entry midwives, hospitals, physicians, local health departments, and other health care providers assisting in birthing children report each confirmed case of a birth problem to the registry within 60 days of the birth. The law requires that the entities listed above are required to report birth problems to the registry within 60 days of recognizing the problem in the following instances:
- When a child is diagnosed with a fetal alcohol spectrum disorder before the child turns 5 years old
- When a child is diagnosed with an autism spectrum disorder at any age
- When a child is diagnosed with any birth problem before s/he turns 3 years old
In making these reports, the entities listed above can use information submitted to any other registry or information filed with governmental agencies. The law allows exchange of information between state department registries as long as the confidentiality restrictions of each registry are maintained.
