Inclusion of Health Care Proxy in the Medical Record
This section of the law discusses a health care provider’s obligations with respect to health care proxies (defined as a legal document that delegates the authority to make health care decisions under N.Y. Pub. Health Law § 2980-8) and agents (defined as the adult to whom authority to make health care decisions is delegated to through a health care proxy under § 2980-5).
When a health care provider receives a health care proxy, s/he is required to include the health care proxy in the patient’s medical record in case it’s not already included. The rest of this section of the law discusses the health care providers’ obligations with respect to recognizing and honoring the health care decisions made by a health care agent.
