The Commissioner of Public Health must establish guidelines for reviewing complaints against physicians. These guidelines must address, at minimum, (1) screening complaints; (2) prioritizing complaints; (3) conducting investigations in a manner that results in “prompt action when…necessary;” (4) expanding the investigation beyond the complaint “to include, sampling patient records to identify patterns of care,…, and reviewing performance and discharge data from hospitals;” and (5) the means of keeping patient and provider identifying information confidential when broadening an investigation.
