“Capacity of principal; procedure under the Florida Health Care Surrogate Act”
A patient is presumed to be capable for making his or her own health care decisions unless a physician determines that the patient is incapacitated. If the patient is incapacitated, the patient’s health care surrogate is authorized to act on behalf of the patient.
