“Practitioner disclosure of confidential information and immunity from civil or criminal liability under the regulation of professions and occupations law”
A health care provider is not civilly or criminally liable for the disclosure of otherwise confidential information to a sexual partner or a needle-sharing partner of a patient if the patient has tested positive for HIV, the patient discloses the identity of a sexual partner or needle-sharing partner, and the patient refuses to notify the third parties of potential exposure to HIV infection.
