“Resident transfer or discharge; requirements and procedures; hearings under the public health law”
A nursing home resident may challenge a decision by the facility to discharge or transfer the resident. A nursing home must provide advance notice of the proposed transfer or discharge to a resident or to the resident’s family member, legal guardian, or representative. The notice must be in writing and be given at least 30 days prior to the transfer or discharge. A resident may request that the local ombudsman council review any notice of discharge or transfer given to the resident.
